In the Illinois drone market, a simple handshake is a liability. Whether you are offloading a LiDAR-equipped sUAS or a high-end gimbal rig, you need a Bill of Sale that addresses the intersection of FAA Part 107 federal standards and strict Illinois statutes. Beyond just documenting the purchase price, our document helps mitigate risks related to the Illinois Biometric Information Privacy Act (BIPA) if your drone stores facial recognition data, and ensures you meet the $500 threshold requirement for written contracts under 740 ILCS 80/1. Protect yourself from future property damage claims or airspace violations attributed to a drone you no longer own.
Beyond the standard bill of sale sections, this template adds fields specific to Drone Pilot:
A Bill of Sale serves the core legal purpose of providing proof of the transfer of ownership of an item from the seller to the buyer. It formalizes the transaction and fulfills the legal need for documentation of the sale, aiding in preventing disputes over ownership and clarifying the terms and conditions agreed upon by the parties involved.
FAA Regulation Violations
Contracts can specify that pilot maintains active Part 107 certification and compliance with all FAA guidelines.
Privacy Invasions
Agreements often include clauses ensuring compliance with federal and state privacy laws, as well as specifying data collection practices.
If you are selling a drone with internal storage containing biometric data or facial recognition software, Illinois law is exceptionally strict. It is vital to include a clause confirming that all data has been wiped and that the buyer acknowledges the privacy compliance requirements of BIPA before operating the payload.
To ensure enforceability and avoid ambiguity, a detailed description is required. For Illinois drone pilots, this means including the FAA registration number and serial numbers for the aircraft and specialized sensors. This prevents disputes over scope of work or equipment condition and helps the buyer transition the aircraft on the FAA DroneZone portal.
Yes, under the Illinois Statute of Frauds (740 ILCS 80/1), any contract for the sale of goods priced at $500 or more must be in writing to be legally enforceable. This document fulfills that legal requirement and provides proof of transfer that protects both the buyer and seller's legal interests.
The Warranties and Disclaimers section is critical for drone pilots. It allows you to sell the aircraft 'as-is' and includes a Buyer’s Acknowledgment that they have inspected the flight logs and are aware of any past crash history, mitigating future claims of consumer fraud under the Illinois Consumer Fraud Act.
