Whether you are selling a custom piece of furniture like a client table or high-end rotary machines, a Bill of Sale is essential for Ohio tattoo artists to prove transfer of ownership and mitigate liability. Under the Ohio Consumer Sales Practices Act and ORC § 1335.05, transactions exceeding $500 require written evidence to be enforceable. This document ensures you are protected from design disputes and future claims regarding equipment sterilization or defect, specifically addressing the high-risk nature of the industry and OSHA Bloodborne Pathogens Standard compliance history.
Beyond the standard bill of sale sections, this template adds fields specific to Tattoo Artist:
A Bill of Sale serves the core legal purpose of providing proof of the transfer of ownership of an item from the seller to the buyer. It formalizes the transaction and fulfills the legal need for documentation of the sale, aiding in preventing disputes over ownership and clarifying the terms and conditions agreed upon by the parties involved.
Bloodborne Pathogen Liability
Using client consent forms acknowledging the risks associated with tattooing, and adherence to OSHA standards for infection control.
Allergic Reaction Claims
Obtaining informed consent from clients about potential allergic reactions, keeping records of ink and materials used, and having disclaimers in contracts.
Ohio Revised Code § 1335.05, the Statute of Frauds, requires that any contract for the sale of goods valued over $500 must be in writing to be legally enforceable. Using a formal Bill of Sale ensures that your transaction for flash designs, equipment, or studio assets is recognized by Ohio courts should a dispute arise.
Yes, our Bill of Sale includes recommended 'Warranties and Disclaimers' (As-Is) clauses. For an Ohio tattoo artist, this clarifies that the buyer accepts the item in its current condition, which is critical when selling items that must meet OSHA Bloodborne Pathogens Standards or equipment that uses specific FDA-regulated inks.
While the primary focus is the physical transfer, the 'Description of the Item' field allows you to specify whether design ownership and rights for custom pieces or flash are included, helping to prevent future design disputes common in the industry.
While not always mandatory for small equipment, notarization or witness verification is recommended for high-value studio sales or when required by specific local health department regulations to ensure authenticity and enforceability under Ohio corporate governance standards.
