Any offer to settle must include payment of a substantial portion of the amount owed and a firm, enforceable timeline for payment of any remaining balance. I am under no obligation to accept any settlement offer, and my willingness to consider one should not be construed as a concession or waiver of any of my rights. Please be advised that pursuant to California Labor Code §§ 2750.3 (AB 5), the nature of the production services rendered may qualify the Sender as an employee under the ‘ABC Test.’ Failure to remit payment for services rendered not only constitutes a breach of contract but may also trigger statutory penalties for unpaid wages, liquidated damages, and reasonable attorney's fees as provided under California law.
The podcast episodes, show notes, and edited masters described herein are protected under the Digital Millennium Copyright Act (DMCA) and the U.S. Copyright Office regulations. Until full payment is received or specific guest release conditions are met, no license—express or implied—is granted for the distribution of this content via RSS feeds, hosting platforms, or social media. Any continued use of said materials will be treated as willful copyright infringement.
