The Buyer acknowledges that the Buyer has had a full and adequate opportunity to inspect the Property prior to the execution of this Agreement and accepts the Property in its current condition as described herein.
The total purchase price for the Property is [sale_price] (the "Purchase Price"), payable in full by the Buyer to the Seller on or before the Sale Date. The Buyer and Seller acknowledge and agree that the Purchase Price represents the fair and agreed-upon value of the Property as negotiated between the Parties at arm's length. The Seller agrees to execute and deliver to the Buyer any and all additional documents, instruments, or certificates as may be reasonably necessary or appropriate to evidence or effectuate the transfer of title to the Property.

In Maryland, home inspectors face unique risks ranging from E&O claims to strict compliance with the MD Consumer Protection Act. Whether you are selling a thermal imaging camera, a specialized moisture meter, or an entire inspection fleet, a formal Bill of Sale is critical. It establishes 'as-is' condition to mitigate missed defect liability and ensures the transfer meets the Md. Code Com. Law § 2-201 Statute of Frauds requirements for goods over $500, protecting your professional assets and preventing future ownership or deficiency disputes.
Beyond the standard bill of sale sections, this template adds fields specific to Home Inspector:
A Bill of Sale serves the core legal purpose of providing proof of the transfer of ownership of an item from the seller to the buyer. It formalizes the transaction and fulfills the legal need for documentation of the sale, aiding in preventing disputes over ownership and clarifying the terms and conditions agreed upon by the parties involved.
Missed defect liability
Include limitation of liability clauses in inspection agreements, specifying maximum liability and exclusions for latent or hidden defects.
Errors and Omissions (E&O) claims
E&O insurance coverage and clear disclosure of scope and limitations of inspection in inspection report to manage client expectations.
Yes. According to Md. Code Com. Law § 2-201, any sale of goods exceeding $500 must be in writing to be enforceable. Our document ensures all required identifiers, purchase prices, and signatures are present to meet this legal threshold.
The document includes specific 'Warranties and Disclaimers' clauses. By selling the item 'as-is' and requiring a 'Buyer's Acknowledgment' of the condition, you mitigate risks associated with future report accuracy disputes or equipment failure during a home inspection.
While the Bill of Sale formalizes the transfer, you must ensure the transaction doesn't violate the Maryland Consumer Protection Act by misrepresenting the condition of specialized tools like radon monitors or mold sampling pumps. This document provides clear 'Description of Item' fields to promote transparency.
