Please be advised that interest on the unpaid balance continues to accrue at the maximum rate permitted by applicable law. Each day that passes without payment increases your total financial liability. Additionally, in the event that legal action becomes necessary, you will be responsible for all attorneys' fees, court costs, and other expenses incurred in the collection of this debt, to the fullest extent permitted by law.
While I am fully prepared to pursue legal remedies if necessary, I would prefer to resolve this matter without the time, expense, and burden of litigation. If you wish to discuss a payment arrangement or negotiate a resolution, you must contact me in writing within the deadline specified above. Any offer to settle must include payment of a substantial portion of the amount owed and a firm, enforceable timeline for payment of any remaining balance. I am under no obligation to accept any settlement offer, and my willingness to consider one should not be construed as a concession or waiver of any of my rights. This letter is written without prejudice to any and all rights and remedies available to me under applicable law, all of which are expressly reserved. Nothing herein shall be construed as a waiver of any legal right or remedy.
The photography services provided are protected under Federal Copyright law and specifically governed by the usage rights outlined in our signed agreement. Pursuant to the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Fla. Stat. §§ 501.201-501.213, any unauthorized commercial use or misrepresentation of the work as described in the Statement of Facts may constitute an unfair or deceptive act in the conduct of trade or commerce. Failure to rectify this usage or pay the corresponding licensing fees will result in further legal action to protect my business interests.
Be advised that Florida Statutes Chapter 542 and related case law regarding professional service contracts strictly enforce the payment of agreed-upon consideration for specialized labor. Demand is hereby made for the full outstanding balance. Pursuant to Florida law, if this matter proceeds to litigation, I reserve the right to seek not only the principal amount owed but also all applicable late fees, pre-judgment interest, and attorney’s fees as permitted by the contract and Florida's civil procedures.
As noted in our primary agreement, my liability for missed shots or equipment failure is limited to the extent permitted by Florida law and the specific limitation of liability clause therein. However, my performance of services on the event date constitutes a complete obligation on the part of the recipient to fulfill all payment terms.
