Such remedies may include, but are not limited to, the filing of a lawsuit seeking injunctive relief, compensatory damages, statutory damages, punitive damages, disgorgement of profits, and recovery of attorneys' fees and costs. A lawsuit will result in a public record of the proceedings and may subject you to significant financial liability. This letter is written without prejudice to any and all rights and remedies available to me, all of which are expressly reserved. Nothing in this letter shall be construed as a waiver of any rights or remedies, nor shall it be deemed an exhaustive statement of the legal theories upon which I may rely.
You are hereby placed on notice of your obligation to preserve all documents, electronically stored information, and other materials that are relevant or potentially relevant to this matter. This includes, but is not limited to, emails, text messages, social media posts, files, records, contracts, financial documents, and any other communications or materials related to the conduct described in this letter. Destruction, alteration, or concealment of such evidence may result in severe legal consequences, including adverse inference instructions and sanctions in any subsequent legal proceeding.
The unauthorized use of the Undersigned’s professional wedding imagery to promote your own services or venue constitutes a violation of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes Chapter 501. Be advised that your representation of these images as your own work or as work you have the right to distribute is inherently misleading to Florida consumers and subjects you to potential civil penalties and attorney fees under state law.
As the author of the works, the Undersigned retains all moral rights and editorial control over the finished product. The display of unedited raw files, or images modified by third-party filters, constitutes a breach of the original Service Agreement and trade libel against the Photographer’s professional reputation. You are hereby commanded to remove all versions of the images that have not been expressly approved and delivered through the Photographer’s official gallery system.
Pursuant to Florida Statutes Chapter 542, this demand seeks to restrain the illegal appropriation of intellectual property that creates an unfair competitive advantage. Failure to comply with this demand by the deadline stated herein will result in the Undersigned pursuing all available legal remedies in the appropriate circuit court of Florida or Federal District Court. We reserve the right to seek statutory damages and the immediate impounding of all infringing physical materials, including wedding albums or print marketing, containing unauthorized work.
