Re: Cease and Desist — Demand to Immediately Stop Unlawful Activity
I am writing to you on behalf of myself, [sender_name], to demand that you immediately cease and desist from the unlawful conduct described below. This letter serves as formal notice that your actions constitute a serious violation of my legal rights, and I intend to pursue all available legal remedies if you fail to comply with the demands set forth herein.
It has come to my attention that you have engaged in the following conduct, which constitutes a direct and actionable violation of my rights: [violation_description]
I hereby demand that you take the following actions immediately and no later than the deadline specified below: 1. Immediately cease and desist from all conduct described above; 2. Confirm in writing that you have complied with this demand and that you will refrain from any further violations; 3. Preserve all documents, communications, records, and electronically stored information related to the conduct described herein, as such materials may be relevant to future legal proceedings.
You must comply with all of the demands set forth in this letter within the deadline specified below. Time is of the essence.
If you fail to comply with the demands set forth in this letter within the specified deadline, I will have no choice but to pursue all available legal remedies without further notice. Such remedies may include, but are not limited to, the filing of a lawsuit seeking injunctive relief, compensatory damages, statutory damages, punitive damages, disgorgement of profits, and recovery of attorneys' fees and costs. A lawsuit will result in a public record of the proceedings and may subject you to significant financial liability. This letter is written without prejudice to any and all rights and remedies available to me, all of which are expressly reserved. Nothing in this letter shall be construed as a waiver of any rights or remedies, nor shall it be deemed an exhaustive statement of the legal theories upon which I may rely.
You are hereby placed on notice of your obligation to preserve all documents, electronically stored information, and other materials that are relevant or potentially relevant to this matter. This includes, but is not limited to, emails, text messages, social media posts, files, records, contracts, financial documents, and any other communications or materials related to the conduct described in this letter. Destruction, alteration, or concealment of such evidence may result in severe legal consequences, including adverse inference instructions and sanctions in any subsequent legal proceeding.
The unauthorized use of the Undersigned’s professional wedding imagery to promote your own services or venue constitutes a violation of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes Chapter 501. Be advised that your representation of these images as your own work or as work you have the right to distribute is inherently misleading to Florida consumers and subjects you to potential civil penalties and attorney fees under state law.
As the author of the works, the Undersigned retains all moral rights and editorial control over the finished product. The display of unedited raw files, or images modified by third-party filters, constitutes a breach of the original Service Agreement and trade libel against the Photographer’s professional reputation. You are hereby commanded to remove all versions of the images that have not been expressly approved and delivered through the Photographer’s official gallery system.
Pursuant to Florida Statutes Chapter 542, this demand seeks to restrain the illegal appropriation of intellectual property that creates an unfair competitive advantage. Failure to comply with this demand by the deadline stated herein will result in the Undersigned pursuing all available legal remedies in the appropriate circuit court of Florida or Federal District Court. We reserve the right to seek statutory damages and the immediate impounding of all infringing physical materials, including wedding albums or print marketing, containing unauthorized work.

Beyond the standard cease and desist letter sections, this template adds fields specific to Wedding Photographer:
The core legal purpose of a Cease and Desist Letter is to formally request or demand the recipient stop a specific action that is infringing upon the sender's legal rights. It serves as a preliminary step before potential legal action, seeking to resolve the issue without immediate litigation.
Copyright Disputes
Clearly state copyright ownership and usage rights in the contract, often retaining the copyright while granting limited usage rights to clients.
For this cease and desist letter to be legally valid:
Common mistakes to avoid:
Small Business Administration Regulations
While there are no specific federal regulations for wedding photographers, business operation regulations from the SBA apply. This includes tax obligations, business licenses, and adherence to employment laws.
Enforced by U.S. Small Business Administration (SBA)
State Photography Licensing
Some states or local jurisdictions might require a general business license or permits for photographers, particularly for shooting in public spaces or venues.
Enforced by State and local governments
Recommended coverage: Professional Liability Insurance (Errors & Omissions) · General Liability Insurance · Equipment Insurance · Business Interruption Insurance
Unless your contract specifically grants the venue a commercial usage license, you retain the copyright. Under Florida law and federal copyright standards, using your work for their profit without a license constitutes infringement. This letter demands they cease use of your intellectual property immediately.
Most wedding photography contracts include a clause protecting the photographer's stylistic brand. Posting raw or 'leaked' files can damage your professional reputation. This letter cites the breach of contract and demands the removal of images that violate the delivery standards outlined in your agreement.
Yes. Beyond federal copyright, the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) can be invoked if a competitor or business uses your work to mislead the public about their own services, providing a state-level avenue for stop-and-desist demands.
