This letter is written without prejudice to any and all rights and remedies available to me, all of which are expressly reserved. Nothing in this letter shall be construed as a waiver of any rights or remedies, nor shall it be deemed an exhaustive statement of the legal theories upon which I may rely.
You are hereby placed on notice of your obligation to preserve all documents, electronically stored information, and other materials that are relevant or potentially relevant to this matter. This includes, but is not limited to, emails, text messages, social media posts, files, records, contracts, financial documents, and any other communications or materials related to the conduct described in this letter. Destruction, alteration, or concealment of such evidence may result in severe legal consequences, including adverse inference instructions and sanctions in any subsequent legal proceeding.
The Recipient is hereby notified that their current actions constitute a breach of the restrictive covenants governing competition and solicitation within the Florida barbering industry. Pursuant to Florida Statutes Chapter 542, the Shop Owner has a legitimate business interest in protecting its trade secrets, specialized training, and substantial client relationships developed at the Salon/Shop. Demand is hereby made that you immediately cease any barbering services within the restricted geographical area and refrain from further contact with current or former clients of the Shop.
Failure to adhere to the health and safety standards mandated by the Florida State Board of Cosmetology and the Occupational Safety and Health Administration (OSHA) places the Shop's establishment license at risk. You are commanded to immediately cease and desist from any practices that violate Florida administrative codes, including but not limited to improper sterilization of shears, clippers, and neck dusters. Any further violations will result in the immediate termination of chair rental privileges and a formal report to the Florida Department of Business and Professional Regulation (DBPR).
Be advised that your use of the Shop's name, 'fades' or 'tapers' techniques unique to this brand, or misleading marketing constitutes a violation of the Florida Deceptive and Unfair Trade Practices Act. The Shop Owner reserves the right to seek civil penalties, attorney’s fees, and injunctive relief for any conduct that is unconscionable, deceptive, or unfair as defined under Chapter 501, Part II, Florida Statutes.
